Our position is they need to do the right thing and honor their obligation. In our opinion this is a clear-cut case of breach of contract and we intend to seek redress in the courts.

The reason we've filed is because Connecticut General Life Insurance has continued to not live up to its obligation.

We believe it's absolutely unfair and unjust that they just arbitrarily say they won't pay. There could be no question in anyone's view that he is suffering from a disability. We are absolutely confident that we will prevail.

This is really sad that an insurance company the stature of Connecticut General wouldn't stand up and say, 'We're going to do the right thing,' instead of looking for ways to avoid their contractual obligations. Several millions of dollars in premiums have been paid to purchase this policy, beginning in 2001. If Jeff isn't totally disabled, what would it take? What would it take for him to be totally disabled?

We have not filed (a lawsuit) yet. We will ask them to reconsider their decision based on the information Mr. Bagwell has provided. If they continue denying the claim, we will file litigation against Connecticut General. We're going to give them several weeks to reconsider their position.

We wouldn't file it if we weren't optimistic. We think it's a deserving case and we think it's a very clear-cut case. This lawsuit is based on breach of contract.
